Welcome to Tree Appraisal Pro, a service provided by Helion Minds ("we," "our," or "us"). By creating an account or using our software, you agree to be bound by these Terms of Service ("Terms").

1. Professional Use Only

This software is designed exclusively for use by Consulting Arborists, Landscape Architects, and industry professionals. While the software automates calculations based on the Guide for Plant Appraisal (CTLA) Trunk Formula Method, the final opinion of value, species ratings, condition assessments, and site factors are the sole professional responsibility of the user.

Helion Minds does not provide legal advice. Reports generated by this software are tools to support your professional opinion. We do not guarantee specific outcomes in litigation, insurance claims, or IRS disputes.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

Pricing: We offer pay-per-report credits and monthly subscriptions (e.g., "Arborist Pro"). Prices are subject to change with reasonable notice.

Refunds: Due to the digital nature of our generated reports and immediate access to tools, all sales are final unless otherwise required by law.

Cancellation: You may cancel your subscription at any time via the Dashboard. Access remains active until the end of the current billing period.

4. Intellectual Property

Your Data: You retain ownership of the tree data, photos, and client information you upload. By using the service, you grant us a license to host, process, and display this data solely for the purpose of providing the service to you.

Our IP: The software interface, calculation engine, branding, and report templates are the property of Helion Minds. You may not reverse engineer, copy, or resell the software itself.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, HELION MINDS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL HELION MINDS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFESSIONAL REPUTATION, OR REVENUE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
